Hello sir,

My problem is that my previous company terminated my employment in the middle of December 2018 without giving any oral or written warning. Firstly, they are delaying my November 2018 salary. When I inquired about the salary again, after a full day of work and at the time of leaving, they informed me that my salary would be credited after 30 days and that it was my last day of work there without providing any reason.

I have one and a half months pending, and they are not responding to my emails or phone calls. I have been working at this company since July 2018, and the company has been deducting my TDS from that month. I have also discovered that the company has not paid any TDS to the respective department. Additionally, the company made me sign an agreement in September 2018 stating a two-month notice period requirement.

Now, I wish to claim two months' extra salary due to the immediate termination of my employment without following any of the company's rules. I have sent numerous emails to the company, but they are not responding. The amount involved is 3.5 lakh plus the TDS they deducted from my salary but have not paid yet.

Duration of service in the company: 6 months.

Kindly assist me in obtaining the amount from the company. Thank you.

Dear Ajay,

For the outstanding salary dues, you can file a complaint against your employer at the labor office in your area. For TDS deductions, you can file a complaint with the IT Department.

Thanks for the reply, could i also claim for 2 months salary for immediate termination? And also i have not much idea about how to file case in labour. Could you tell me the procedure?

Dear Dinesh Divekar,

As per your comment dated 28th January 2019 regarding the unlawful termination of an employee, if an employee secures a new job just 2 days after termination, can they still be held liable to claim a notice period of 2 months' salary from the previous employer?
