Hi all,

I am in a situation where to give up or fight. Currently, I am working in a company where the notice period was 60 days initially, and in the middle, they changed it to 90 days. I have accepted it, but now I have received a better offer where they are asking me to join in 60 days.

Please suggest how I can negotiate the 30 days. In the appointment letter, there is a lieu of option, but it is the sole decision of the company. I am totally stuck and struggling to make a decision.

Please suggest.

Dear friend,

There is no point now in discussing the validity of the subsequent modification of the initial notice period since you have already accepted it. If the buy-out option of the notice period is subject to the discretion of the employer, any forceful insistence from your side in this regard would certainly strengthen the ego of the management and may prove to be futile. Therefore, be polite and convincing in your approach right from the level of your reporting officer to that of your functional head.

When you acknowledge the same, then it means you don't have any objection, and you are accepting it. So if you want to leave, then you must serve the said 90 days' notice period; otherwise, the same will be deducted from your full and final payment.

Please request your hiring manager. In most organizations, it is manager-driven, and if your hiring/reporting manager agrees, the rule could be relaxed, and you can be relieved upon completing the commitments of your role to the satisfaction of your manager. Just request and seek help.

In the employment contract, the period of notice is written as 30/60/90 days or may be altered later on. However, the employment can be terminated by either party with a Notice in writing of 30/60/90 days or in lieu of Notice, salary may be provided (less the period of Notice).

Please review your appointment letter or any modification letter to confirm if salary in lieu of Notice is provided. If so, you can be relieved by paying the salary for the number of days less than the notice period.

Hi all,

Thank you for the update. I have spoken to my reporting manager, and currently, three of our tenured employees have handed in their resignations. The manager is refusing to reduce the notice period. Is there any way that I can get relieved? It's a golden opportunity I received from X company. Please help me somehow.

Thanks in advance.

Hi All,

Please help me. I have spoken to my manager, and she is not ready to let me leave in 60 days as two other people have submitted their resignations. Please suggest a way for me to be relieved earlier. They are also not agreeing to a payout. It's a hard time for me, please help.
