I am working in a startup company in Mumbai. I have been working here since June 2018. On 25th December, I took leave, and when I returned on the 26th, it was marked as unplanned leave and LOP. I just wanted to know if an organization can mark LOP on a public holiday.

Was the 25th December, 2018 declared as holiday by your Organization? You took planned leave on 25th December, 2018 in advance with duly approved by the concerned Approving Authority?

Hi Prashant,

25th December is an optional holiday in my company, but it was not approved by the authorities. They told you that you don't have any leave in the kitty. Since you joined in June, you will only get 3 optional leaves, which you have already taken. My point is, does compensatory off need to be there in the kitty? Because in a year, there are 6 optional holidays I can take.

Three days' prior notice should be required, whether it is in the corporate or private sector, as they may not allow you to take leave on such days. It is better that if you require leave on the 25th of December, you should obtain approval well in advance from the authorized person. This is a basic rule that everyone should know.

If you are entitled for a holiday on 25th Dec, as per Holidays Act of your state, they cannot mark it as lop. Varghese Mathew
