I took 84 days Maternity leave for first baby and second baby but after 3months of birth second baby died due to heart problem.
So now can i get ML for third baby? If it is possible than how many months are eligible to take ML.

You are eligible for 26 weeks. Unfortunate incidents does not come into pictureas those derails wont be mentioned in the dependants list

While confirming the the reply of our learned member JudeGR above, I'd like to add that as per the amendment to sec.5 of the Maternity Benefit Act,1961, the reduction in the 26 week maternity benefit to 12 weeks is applicable only in respect of a woman having 2 or more surviving children.
Since the poster has only one surviving child as of now, she is entitled to 26 weeks maternity leave for the third delivery.

Madam,
If you are working for the same organisation than you are eligible for only 12 weeks for 3rd child as advised by Shri Umakanthan.
Madam if you could permit me and also excuse for my statement, I would like to ask you that are you giving birth to your child for your family or what benefit you are going to get under Maternity Benefit act?
I think for every mother, child is the most precious Gift given by God. You should pray to God for good and healthy child and nothing else.

ESI Local office manager accepted to take 6 months maternity leave for third baby (2nd baby died after 3months of birth) but there are saying we will pay only for 84 days (is it true?). Any chance is there to get 6 months payment or not. Please give your valuable suggestion.

Immediately contact the labiur commissioner of the area werr your company is located and escalate this issue. Widh you good luck
