The maternity leave is awarded with full pay on completion of at least 80 days in an establishment in the 12 months prior to her expected date of delivery. The maternity benefit is awarded at the rate of the average daily wage for the period of a worker's actual absence from work. Apart from 12 weeks of salary, a female worker is entitled to a medical bonus of 3,500 Indian rupees.

You need to pay the salary on the basis of maternity leave on a monthly basis and pay the employee, as the same practice is being followed all over. Maternity leave is for 26 weeks, which is to be paid along with a bonus of Rs. 3500 to help the employee with pre and postnatal care. If your pre and postnatal care is covered by any medical policy held by your company, then the amount of Rs. 3500 need not be paid.

At the outset, the New Amendment namely: Maternity Benefit (Amendment) Act, 2017 does not speak about the mode of payment of salary to the employee on Maternity Leave. The employer has to go as per the provisions of the Principal Act. As per the provisions an employer has to pay maternity benefit at the rate of the average daily wage for the period of a worker's actual absence from work. The average daily wage means the average of the woman’s wages payable to her for the days on which she has worked during the period of three calendar months immediately preceding the date from which she absents herself on account of maternity, or one rupee a day, whichever is higher.

Maternity benefits for pre and postnatal periods shall be paid at the average wages, not as normal salary. Prenatal benefits should be paid in advance, and postnatal benefits as a lump sum as soon as proof of delivery is provided. However, companies typically pay it as regular salary, as if the employee is on paid leave.
