Re: Maternity leave period and encashment

This is Karim. My wife works in an Educational institute (Engineering College) in Telangana State. She took 6 months of leave, but her college HR said only 1 month will be paid. I have a few questions about Maternity leave:

Q1: How many days of maternity leave are allowed in Telangana State?
Q2: How many days of maternity leave are paid for in Telangana State?
Q3: After rejoining the college, will she be treated as a new employee or an existing employee?

Maternity Benefit Act is a central act. as per the act
"• The applicant can avail six weeks leave before the date of delivery and six weeks leave post delivery. The maximum leave benefit under normal circumstances will be 12 weeks (3 months).
• Un-availed Maternity Leave is non-encashable.
• The weekly offs and holidays falling during this period will be part of the leaves availed.
The above is not paid file an application before the Maternity Benefit Act authorities, mostly the authority would be Commissioner of Labour.

In a recent amendment , Maternity leave increased from 12 weeks to 26 weeks, which is not available to women who have already two surviving children and they are restricted to 12 weeks only.
