I require guidance. I have worked for 3 years in a company in Gujarat. The company ceased its operations permanently in 2016, and the employer stopped working in all areas, leading to the closure of the company. Currently, the employer is not available in India.
When we submitted the PF withdrawal claim with the bank manager's signature on the claim form, we discovered that the employer had not submitted Form 9. The PF office informed us that the employer must first submit Form 9 for our claim to be processed.
I am reaching out for advice as a total of 16+ employees are facing problems due to the employer's negligence.
Please provide urgent guidance so that we can proceed accordingly.

You may send a representation to the Asst PF Commissioner requesting him to consider the submission of the Form 19 after attesting the signatures by the Bank Managers or others who are approved by the EPFO in the absence of the employer.
In case your KYCs are okay and Aadhar is linked to your PF Account, you need not even submit the Form 19 and 10C with any such person's signature.
Please contact the PF Office and apprise them that the employer has left India.
