Form 16 is a certificate issued by an employer evidencing the TDS that is deducted from your salary and deposited with the authorities. It contains the information you need to prepare and file your income tax return.

If no TDS is deducted, the employer may not give you Form 16. Your question is incomplete without indicating whether TDS has been deducted. If it is deducted, the employer has to give you Form 16.

Thank you for your reply. I am a contract basis faculty in a government organization since 2011. The institute has deducted TDS from 2011 up to 2016 and issued Form No. 16A. In April 2016, we filed a petition in the high court regarding regularization. Since April 2016, we have been working due to the court's direction on the same payment. From FY 2016-17, they have not deducted the tax and have not provided Form No. 16A.
