I have been recruited to a new organization, and they are demanding an experience letter from my previous company. However, I was terminated from my service due to poor attendance caused by health reasons. Now, when I am asking them to give me the experience letter, they are refusing to do so. The organization is a small and medium-sized enterprise (SME) with 20 employees. Kindly advise on what steps I should take.

What will you do with a service certificate that mentions that your services were terminated? In the service certificate (experience letter as mentioned by you), the reason for the separation of the employee is mentioned.

Terminated from service due to health reasons. I would like to know one thing: did you provide a doctor's certificate to the company? In my opinion, no company will terminate an employee if they are not able to report to work due to health reasons.

A company is not obligated to provide an experience letter if they have terminated you. Only if you formally resign will the company provide you with an experience letter.

Kindly check the appointment letter and study the terms of termination of employment. The company might have mentioned: either party can terminate the employment by a notice of 3 months or notice pay in lieu of notice; then there is no scope of any dispute.

Due to health issues, you are terminated from the job. It's better to coordinate with HR as, in good faith, they will provide the same for your future prospects.

Yes, don't bother about the experience certificate. Tell the new company the facts. It is a reasonable cause for us also, so that gentlemen will recruit you positively. Struggling with the old company is a futile effort and a waste of time. Try to convince new management with true behavior, that's all.

yes, you can take experience certificate from the previous company for the period you have worked. in the experience certificate reasons for termination need not be mentioned.

Yes, you can ask for the experience letter from your past employer, and they have to give it to you as you have worked in the company.

For the word "termination," you can discuss with the HR not to mention the termination word in your letter.

The issue of experience certificates is governed by the relevant Acts on the conditions of service, company policy, or contract of employment. The Factories Act is silent on this. Check the Shops and Commercial Establishments Act of your state.

In Kerala, shops and commercial establishments shall issue a service certificate if asked by the employee.
