Dear All Members,

I want to know the applicability of the above-said acts, i.e., EPF and ESI. In my current firm, we have only 8 employees, and I read on the EPFO website that "the act will be applicable to the firms who are having 20 or more than 20 employees." Does this mean our firm doesn't come under EPFO? Similarly, regarding ESI, on their website, they stated "the act will be applicable to 10 or more than 10 employees."

I kindly request all the senior members to guide us and clarify the above-said acts.

Thanks & Regards,

Preet

If you have only 8 employees working including all contractual/outsources employees working at your premises then PF & ESI Act will not be applicable to you.

Dear Preet,

Even directors are included in the employee category. So, if you have 10 or more employees, including the director, then you are required to be registered under ESIC.

If you require any further guidance, feel free to contact me.
