Hello,
My wife is working in small electronics company, she is joined as quality testing engg. but she didn't got appointment letter as well as all employees there are getting salary in Cash. As no. of employees are less all employees are forced to stay after their work hours as well as they have to come for work on their weekly off days. So is it good practice? What will be the solution for that? Can anybody suggest me something?

Dear Sachin,
This is a common problem in small organizations. The employer always exploit the workers. They give bribe to the labours inspectors and others. They maintain false record to show them. You cant to anything alone against this. You can go against this in labour court but not alone, with other employees of that organization or you can talk with the employer of that organization with all workers.

Salary can be paid by cheque or cash. It is provided for in the Payment of Wages Act.
Forcing employees to work beyond the working hours and failure to pay overtime for the extra hours of work performed are violations of provisions of Labour Acts and they can be brought to the notice of the enforcing agency for grievance redressal.

The problem is such that nothing can be done, except to stay there till your wife gets another option. Nothing can be done against the employer also as your wife has not been given appointment letter.
Just have patience, if your wife needs work experience, ask her to stick there for a while. Then she can proceed for another job.

Hi,
Even if you wish to complain to authorities, they may pay bribe/ may not show all are employed there. In the absence of any proof of working such as salary slip, appointment letter, Form 16, EPF Statement etc., it will be foolish to fight against them.
If you do not like there, you move out. But most small companies operate like this. The fact that employees are still working there shows that the employer may be paying them handsomely. That is the reason, no body is protesting or opting out.
So choice is yours. To stay or not to stay there.
