My name is S. Nishanth. I was working at Akriti Construction Company. I left the job and submitted my resignation letter to the HR. He mentioned that he would release my full and final settlement after one month. It's been one and a half months, and they still have not released my salary. When I inquired about my salary, they informed me that I have been absconded, so they can't pay me. Additionally, they said that I can do whatever I want if I wish to.

What was your notice period as per the appointment letter? Have you been given any acknowledgment of the resignation? Please check with him how it is treated as absconding if your resignation is accepted and acknowledgment issued.

HR has to follow due procedures for absconding cases. Talk to him and settle the matter.

Acknowledgment of a resignation letter is not an acknowledgment of the notice period mentioned therein. It simply indicates that the resignation has been accepted. The relieving letter is the definitive letter of acceptance of your relieving date as mentioned in it. As suggested, you need to first check your appointment letter for the notice period clause.

Many companies nowadays have started the practice of issuing conditional acceptance letters that mention the relieving date will be decided later, along with the routine resignation procedure.

They did not issue me the offer letter too. Neither the project manager nor the HR informed me to serve the notice period. The CEO of the company is saying that you don't know you have to serve the notice period, and for that reason, you have been considered absconded from the company.

If there is no offer letter, then how did they ask you to serve notice period? You can politely inform them that they cannot force you to work without justification. Speak to HR for the final dues.
