Hi, I have recently joined a Ltd company on probation for about 1 year. However, within a few days of joining, I had stopped going to the company and communicated to them the reason for medical grounds. After a few days, on the 1st day of the month, I received a part salary for the number of days from when I joined the company from the payroll department. It has only been a few days, and my question is: I have not yet tendered any resignation letter to them, and the stipulation mentioned in the offer letter clearly states that:
i) It is mandatory to serve a one-month notice period in case of resignation of service after confirmation. Even during probation, it is stated that I have to serve a one-month notice, and one month's salary in lieu of notice period is not acceptable.
There is no mention of any legal actions that could be taken, but if I choose not to rejoin the company, what should be my course of action from here on? Should I provide a medical certificate, but that might give the impression that I am fit to join for service again.

Resignation Letter is a must to terminate the employment; instead of just walking off, you should have tendered your resignation. Now, since your employment has not sent you any letter, stay calm and wait for their reaction, if any.

It is not quite understood why you have stopped going to work. Sickness is a valid reason. If you truly do not want to continue the job, it would be better to submit your resignation. Otherwise, you may encounter problems in securing future employment.

It is always a better and recognized procedure to give a letter of intimation (even if you are in the probation period) to your employer when you are leaving the service. This letter will inform your employer that you will not be reporting for duty, allowing them to make alternate arrangements for their work.
