Hello everyone.

I am a complainant under this act and now jobless since I resigned when I was forced over the phone for termination due to my complaints. After my resignation, the company formed an ICC at a back date. However, in their policy, they have not provided an ICC formation date, even though I asked several times via email for its formation date. The ICC is evidently biased and working in favor of the respondent, trying to disprove my complaint as false. I am striving hard for redressal.

My queries are:

1. I have no witnesses now, although I had some initially. However, they would not speak in my favor as they are all currently employed by the same company. Will this lack of witnesses work against me?

2. The respondent has presented fake witnesses. I can address this by cross-examining them, but how would that be beneficial when the ICC is already biased?

3. Can I be accompanied by any of my relatives who are aware of the incident during the cross-examination of the respondent's witnesses?

4. The witnesses who supported the complainant provided their testimonies to the ICC in the absence of an Independent member. Is this acceptable?

5. I requested legal assistance in a prayer to the Presiding officer, which was denied, stating they are not authorized to provide it. Now, after filing a Criminal case, the Presiding officer mentioned that the ICC would have happily assisted me if I had shared with them for the same.

I kindly request all of you to guide and advise me on the same.
