Can anyone help me in knowing if there is any clause in maternity leave benefit act about how many months before taking maternity leave should an employee inform the employer?

Dear member, you have not mentioned whether your question relates to the claim of maternity benefit under the ESI Act, 1948 or under the Maternity Benefit Act, 1961. In case you are not covered under the ESI Act, 1961, you can claim the said benefit under the Maternity Benefit Act, 1961 provided you are eligible for the same.
I think the procedure to claim the benefit under the MB Act, 1961 must have been explained in the Rules as framed by the appropriate State Govt. where you are residing. In case you are residing in Karnataka, I hope the Maternity Benefit Rules as framed by the Karnataka State Govt. will be applicable. For more details, you can get a copy of the same from any law-book shop in the area. So far as I understand, you are required to obtain a Medical Certificate on the prescribed form (as per said Rules) and submit your application/intimation or notice to your employer on the prescribed form. I think to certify from which date a woman is required to be absent from work due to confinement/miscarriage, etc., is a medical issue and is to be certified by the competent Medical Officer/Medical Practitioner as laid down under said Rules.
I think regarding all the above procedures, you can also confirm the position from the concerned HR/HR department of the organization where you are working.

It's easy for an employee to inform her employer about maternity leave. The key information she needs to know is that maternity leave consists of 26 weeks in a ratio of 8/18 - 8 weeks prior to delivery and 18 weeks post-delivery. The employer should be informed about the employee's delivery date at least a month or two before going on leave. Some employees may request additional leave by working extra hours before the delivery date, for example, taking 6 or 4 weeks of leave before delivery.

May I know if an employee avails her 6 months maternity leave and then she decides to resign, what is the procedure in this scenario? Should the company accept her resignation or should they recover the maternity leave paid to her?
Also, what if an employee, after availing her 6 months maternity leave, applies for PL without attending the office? Do we have any notification or clarity in this case?
The location is Mumbai. All these cases are not under the ESIC act.
