Hi, Can anyone answer this question?
There is any employee whose Gross salary is below 21000/- till mar'17 and he is liable to pay the ESI contribution. And the company has to revise his salary w.e.f Apr'17 but because of some reasons it could not revise in Apr'17 and his Apr'17 salary was paid as per his old salary and esi deducted and paid to ESI dept. And the salary increment was done in May'17 effective from 1st Apr'17. And as per his incremented salary his esi amount was not be deducted. And I know that the contribution (ER+EE) can not be refunded once it is paid to esi dept. But my question is why can't the employer refund employee contribution from his side which was actually not be deducted as per incremented salary.
