If your company's manpower is less than 1000, it is legally required to be paid by the 7th day of the following month. You will be legally correct if you lodge a written complaint with the labor office of your workplace. To address this issue without causing harm to your employer, write a letter signed by a few employees requesting payment of the overdue salary within 3 working days. If possible, obtain signatures from other employees as well. If this action does not prompt the desired response, send an official letter to the labor office with a copy to the employer.

Puja,

You surely can make a complaint to the labor officer or send a legal notice through counsel, but it can sour your relationship with the employer. Alternatively, you can wait for a few more days or talk to the employer directly.

1. If you take any action or go against your employer, then your relations with them will definitely be spoiled.

2. You can approach the Labor Officer of the area having jurisdiction over your company and file a complaint against your employer for defaulting on salary payments.

3. You can hire a lawyer who specializes in employment matters and send a legal notice directly to your employer.

4. Your employer can be fined by the authorities, and in severe cases, they may even face imprisonment, although this is extremely rare.
