Dear Experts,
Please let me know if I worked for 6 days from Monday to Saturday, then can I get 1 paid week off?
And one more question: which is correct when counting days in a month, 26 or 30, while calculating salary?

If you are monthly rated employee then you will get 6th day as paid weekly off. Answer to second question will depend on why you want to count them.

Please tell the actual issue. Both calculations are correct - 26 for workers and 30 for staff. In the case where you leave your job without serving the notice period and demand the salary for the following Sunday despite working till Saturday, you won't receive it.

Hello Shrikantbhai,
For example, if working days are 26 days and monthly days are 31, and the present days of a salaried employee are only 23 days, then how do you calculate the salary for that employee?

Hi,
Let's make it very simple. If you are working as a daily wage earner, then the count of 26 would be taken as the denominator factor. If you are an employee working on a monthly salary, then it would be 30 or 31, depending on the maximum number of days in the month.
Some companies have started the malpractice of adopting the denomination factor of 26 even in the case of monthly salary employees. Any absenteeism or unapproved leave will save them a significant amount when applicable on a large base of employee absenteeism. There is no provision in the law to challenge this; however, it can be raised as an unfair labor practice.

Pay Period is any period of consecutive 30 days (except for the month of February), including Actual Working Days plus Days on which Weekly Off is allowed or availed by an Employed Person.
A Weekly Off Day is one day in each calendar week of 7 consecutive days and is allowed or availed as per the Employment Laws of the Land.
Due to exigencies of work, the Employer is allowed to use their "Discretion" to ask or instruct an Employed Person to defer his or her regular Weekly Off to another day in the following week, subject to the proviso that the deferred Off shall be allowed or availed within ten consecutive days of continuous employment. This is humane and also lawful.

Dear Akshay ji,
If you work for 6 days in a week, the last day of the week should be a paid holiday for all workers. This is called a weekly holiday. In every firm, the employer of the establishment should give one day of paid holiday to all workers according to norms. Generally, if it is a factory, he can give Sunday as the holiday. If it is a hotel, hospital, milk unit, or any perishable production unit, he can give individual weekly offs - for some Sunday, for some Monday, and so on.
The calculation of daily salary is the monthly salary divided by 26; it comes to one day's salary. Okay.

I don't know why people are confused and asking why some months have 30 days, some have 31 days, and February has 28 days, etc. In your appointment letter, the management has given you a specific monthly salary. Please note that in February (28/29), you will receive this salary; in March (31), you will receive this salary, and for June (30), you will receive this salary.
A monthly salary means that whether it is 28, 29, 30, or 31 days, every employee is paid the same monthly salary, irrespective of the number of days in the month. Typically, every employee is provided with a weekly holiday, so the number of working days per month is 26 days, with 4 days designated as holidays. There is no need to worry about an excess or a shortfall in the number of days in a month.
