Please be informed that there has been an amendment in the Employees' Compensation Act. Now, the employer must inform new employees about their rights under the Employees' Compensation Act, 2017, by displaying an abstract of the act or providing the provisions in English, Hindi, and the local language. Failure to comply will result in a minimum penalty imposed on the employer of Rs. 50,000 up to a maximum of Rs. 1,00,000.

Central Legislature has received the Assent of the President on 12th April 2017 for the Employees’ Compensation (Amendment) Act, 2017. Extract of the Amendment Act, 2017 is attached.
The following are the amendments:
¢ Appeal in HC will be for a disputed amount of more than Rs.10000 instead of the current Rs. 300 (Section 30 (1)
¢ Increase in penalty for contravention of the Act to Rs 50,000 which may extend upto 1 Lakhs from the current Rs 5,000.(Section 16)
¢ Every employer shall immediately at the time of employment of an employee, inform the employee of his rights to compensation under this Act, in writing as well as through electronic means, in English or Hindi or in the official language of the area of employment, as may be understood by the employee. (Section 17 A inserted)
¢ Commissioner could exercise discretion to withhold payment of an employee whenever an appeal in a high court is now omitted (Section 30 A)
*** Date of enforcement of this amendment is yet to be published in the Official Gazette by the Central Government, please.
