In our organization, there is an employee who has emailed a resignation letter but didn't mention serving the notice period. When asked about it, she refused. Please help me with the format of non-acceptance of resignation due to not serving the notice period.

Legally, what are the other things that need to be taken care of while dealing with such situations? Please help. Awaiting a favorable reply from a helper.

First, reject her resignation with immediate effect. Ask her to serve the notice period or pay in lieu thereof as per the appointment letter, upon which the resignation would be accepted. If she remains absent or does not serve the notice period, mark her as absent from service without permission or authority. You may issue a charge sheet or show cause and initiate disciplinary proceedings, and then you may terminate her employment. Please note that this process can be time-consuming and expensive.

Otherwise, you may choose to wait for her to complete the notice period. If she does not, you can adjust the full and final settlement by deducting the notice pay.
