I am working as a Senior Software Engineer. I am not getting any promotion or career growth in my present company and have discussed multiple times with my Immediate Reporting Manager assigned to me as part of every year's appraisal cycle. I feel like I have been cheated by this organization and that I have wasted my time for over 5 years without receiving any benefits, remaining on the same salary, and not having any onsite travel opportunities.

I have reached out to my HR team and escalated the issue that my managers are lethargic in finding an onsite project for me even after my visa has been stamped. My manager is keeping me in my current assignments and not allowing me to move to onsite projects.

How can this situation be handled when the employer is essentially cheating the employee in the following ways:

1. Retaining and harassing an employee without offering promotions or incremental salary raises.
2. Not providing the employee with exposure to other projects and multiple opportunities for their own benefit.
3. Even after escalating to the HR team, HR is not addressing the situation and is ignoring the employee's concerns, choosing to discuss with the same managers where the employee's efforts have seemingly gone to waste after more than a year of discussions.

Please advise.

In the IT sector, the percentage of employee attrition is highest. Even then, why did you hold on to the same organization for five long years is not understood? You have not just continued in the same organization but that too without any career advancement. Your employers kept dangling the carrot of benefits, and you kept hoping fondly that one fine day you will acquire them. After five years, you have realized that it was a mirage.

Companies give promotions to their employees because timely career growth is one of the means of controlling employee attrition. The growth of the company complements with the growth of the employees. One cannot grow at the expense of the other. However, in your case, the organization had realized that you would continue with them anyway, or your exit would not matter much to them. Giving promises was enough for them, and you were gullible to take these at face value.

Anyway, now the past cannot be undone. You may start searching vigorously for a new job. Since you have completed more than five years in the same company, you are eligible to get gratuity. This statutory benefit may not be significant, but neither is it insignificant.

By chance, if your current organization tries to retain you, then you may negotiate with them to give you a backdated promotion letter and also arrears from the backdate. If they agree, then well and good; otherwise, it is high time for you to say goodbye to your company.

Your case does not fall under the provisions of labor laws. Employee promotion is at the discretion of the employer. Possibly your wages are well above the minimum wage; hence, your case does not fall under the purview of the Minimum Wages Act.
