In our company, the notice period is six months. You will agree with me that no company will wait for six months for a new recruit to join. They are taking 3-4 months and making the resigned employees chase them to confirm the earlier relieving date. In some cases, people are prepared to surrender earned leave, and some are prepared to pay the salary. I heard (from the engineer who recently resigned) that they take Basic and DA for the payment of notice period wages.
I request your suggestions on how to handle the above situations when leaving.

I presume that the 6-month notice period is mentioned in the offer of appointment. I agree that a 6-month notice period is unrealistic at all levels. Over the years, if new joiners refuse to accept a 6-month notice period at the time of joining, then the recruitment pressure will ease out the notice period back to, say, 3 months. In my opinion, there is no legal perspective to the notice period.
