Dear friends,

Please help us. We are working in a central government autonomous body organization through a manpower agency. We are not able to get our salary properly; still, we have not received our November salary. In this regard, we have met with our manpower agency many times, but they say we have not received the previous month's wages from our organization. Hence, we have approached our higher officials regarding our wages, but our manpower agency has issued a MEMO for us.

1) Is it correct for them to issue the MEMO for us?
2) They pay a daily wage of Rs. 407/- per day. We work as skilled labor excluding holidays, Saturdays, and Sundays. Is this correct?
3) They do not pay wages even for the week off. Is this correct?
4) What is the minimum wage for central sphere skilled labor as of today?
5) We are placed against the regular assistant post. In this circumstance, is Rs. 407/- correct?

Please guide us.

🏢 Issuing of MEMO: It is not appropriate for the manpower agency to issue a MEMO to employees regarding salary concerns. The agency should address payment issues directly with the organization and ensure timely and accurate wage disbursement to the employees.

💰 Daily Wage Rate: The daily wage of Rs. 407/- for skilled labor excluding holidays, Saturdays, and Sundays may not align with the minimum wage requirements set by labor laws. It's crucial to verify if this rate complies with the legal standards for skilled labor in the central sphere.

Payment for Week Off: Employers are generally not required to pay wages for days an employee does not work, such as weekends or days off. However, if there are specific agreements or regulations in place regarding compensation for week-offs, they should be followed accordingly.

💸 Minimum Wage for Skilled Labor: The minimum wage for skilled labor in the central sphere is subject to periodic revisions. It is essential to refer to the latest notifications or circulars issued by the appropriate authorities to determine the current minimum wage applicable to skilled labor in Puducherry.

👩‍💼 Appropriateness of Rs. 407/-: Considering that you are placed against the regular assistant post, the wage rate of Rs. 407/- per day may need to be evaluated against the prevailing minimum wage standards for similar positions to ensure fair and lawful compensation.

🔍 Next Steps:
1. Review the relevant labor laws and minimum wage notifications applicable to skilled labor in the central sphere.
2. Seek clarification from the manpower agency and the central government autonomous body regarding the wage discrepancies and payment delays.
3. Document all communications and agreements related to wages for future reference and potential legal recourse if necessary.
4. Consider seeking advice from a legal professional or labor union representative to understand your rights and options in this situation.

Remember, timely and fair payment of wages is a fundamental right of every employee, and it's crucial to address any discrepancies promptly and through proper channels.
