Thank You Sir, I refered your reference link but it is not clear understanding for me because first A Sub Section (i) point mention 12 weeks to 26 weeks but same A sub Section (ii) mention Two or more than Surviving children 12 weeks only . So, May i know the first delivery only eligible for 26 weeks and two and more than delivery eligible for 12 weeks or please clarify my doubts.
(A) in sub-section (3)—
(i) for the words ‘‘twelve weeks of which not more than six weeks’’, the
words ‘‘twenty-six weeks of which not more than eight weeks’’ shall be substituted;
53 of 1961.
(ii) after sub-section (3) and before the first proviso, the following provisoshall be inserted, namely:—
‘‘Provided that the maximum period entitled to maternity benefit by
a woman having two or more than two surviving children shall be twelve
weeks of which not more than six weeks shall precede the date of her
expected delivery;’’;

Please note, the attached document is only a bill that has been passed in Lok Sabha and Rajya Sabha. The format for the gazetted notification is yet to be released by the concerned authority/ies.

I hope you both understand the point.

Dear Thiyagu, you have rightly understood that when the amendment becomes applicable, the 26-week criteria will only be entitled for the first two surviving kids. If a woman applies for maternity leave for a third child, she will be entitled to only 12 weeks.

In case of women who have less than two surviving children (i.e., at least two children), increase the maximum period of maternity benefit from the existing twelve weeks to twenty-six weeks.

In other cases, the existing period of twelve weeks of maternity benefit shall continue.
