Dear all
My query is that, Upon registering as principle employer and engaging contractors in one's premises, is it mandatory that the principle employers also renews his registration certificate, if yes may i know the duration. Or is the registration a one time procedure to be followed by principle employer.

An establishment or factory has to register itself under the Act within 15 days of the Act becoming applicable to it as per Sec.2A read with Reg.10B and once the Act becomes applicable it continues to be applicable to it notwithstanding the fall in the minimum number of employees.So I do not envisage any direction given by the ESI Act to renew the registration, once done. Other views are welcome.

Regn Certificate under CLRA Act need not be renewed. But when there is change in the particulars - Change of Contractor, no of contract workmen to be employed etc., Regn Certificate has to be amended with payment of amendment fee.

I think he is talking about registration under contract labour act
In some states the with a validity date. In such cases it needs to be renewed as long as contract labour is used
In other cases there is ofcourse no need as the registration is valid till revoked or surrendered

Yes, Saswata, you are right, he is talking about registration under CLRA only and I endorse your reply in this regard. The mistake happened as I switched over to this thread after replying an ESI query.

Dear all
Thank you very much for your clarifications, just to make sure that my understanding is correct. So once the registration certificate is obtained by a pricinciple employer under CLRA, it need not be renewed until it is not enforced by the state government to do so by law. As I witness an expiry date on the contractor's license document, I infer from the CLRA that the principle employer has to issue form V to the contractor everytime his license nears expiry for him to extend the enagement of his employees in the principle employer's site of work. Whereas the principle employer's registration certificate doesnt bear any expiry or validity date need not apply for any renewal.
May please confirm or correct me

Contractor's Licence has to be renewed every year and there is no provision for renewal of Principal Employer's Regn Certificate and therefore RC need not be renewed. Form V has to be given to the Contractor only when he apply for Licence for the first time and not every year when he is required to renew the Licence. There is no provision in the TNCLRA Rules for enclosing Form V by the Contractor every time when he apply for renewal of Licence..
