Hello,

I was working in an IT company for 5 years. I signed an employment agreement in January 2016 for one year. However, my father passed away last month in a road accident, and my mother was seriously injured. This led to a financial crisis, and I felt disappointed. Consequently, I resigned from my position with a 7-day notice period as I had a good opportunity in another company. My previous employer was not willing to increase my salary or offer any other assistance to help me support my family. According to the agreement, I was supposed to serve a 60-day notice period or pay 2 lakh rupees. The employer had the authority to terminate any employee without notice and without paying two months' salary. I have since joined a new employer, but my previous employer is refusing to provide a relieving letter and is threatening legal action against me. What is the solution?

Working in a company for five years and signed an agreement for one year in January 2016. You can offer them to serve the notice period, but right now you need a long break due to accidental reasons beyond your control.

If you had resigned to take care of your mother, there would have been a strong legal defense based on impossibility of contract. However, since you have taken another job, this defense is no longer available. Consequently, your employer may pursue legal action against you. Unfortunately, in this situation, your case is weakened. Additionally, the amount of 2 lakh is excessive; courts typically award reasonable damages based on the terms agreed upon in the contract.
