Dear BS Srivastava,

"Wilful insubordination" is misconduct under the provisions of the Industrial Standing Orders Act. However, to investigate whether misconduct has occurred, you need to conduct a domestic enquiry to uncover the facts. The enquiry officer should delve into the causes of insubordination. If the accused employee is found guilty, management may impose punishment, such as "forfeiture of salaries and wages." Please note that the punishment should be proportionate to the misconduct.

Salary cannot be deducted as a punishment for disobedience. However, the principle of 'No work, no pay' could be evoked if the employee has not performed his task. This is no punishment.
