As the head of HR, I have a query to ask. My CEO has requested that I leave the job by giving one month's notice as he cannot work together with me. He will sign the letter, and as HR professionals, it is our responsibility to draft letters for him. My question is, should I submit a resignation letter or write a letter of termination of my employment contract? Alternatively, should I draft a resignation citing that it is as per his instructions? This way, my future employer, upon inquiry, can receive a positive response from my current employer, as termination might result in a negative response. I also do not wish to continue working under these circumstances.
Additionally, will this situation affect my full and final settlement, which includes my gratuity for seven years and leave encashment, etc.?
I have diligently performed my job with honesty, worked hard throughout my tenure, and have maintained a good reputation in this organization. There is no valid reason for my termination; it seems to be primarily based on personal reasons and the desire to replace me with someone else.
Please provide guidance while ensuring legal compliance.
