Could you please help me in understanding the eligibility for gratuity in my case?

Organization Details

Organization Type: Private Company in Mumbai (Big 4 Audit firm). I work 5 days a week, i.e., Monday to Friday, with Saturdays and Sundays off.

Employment Duration

Date of Joining: 21st Nov 2011. I am planning to resign on Monday, 4th April 2016. Expected Last Date at Work: Friday, 3rd June 2016 (considering a 2-month notice period).

If I take 3rd June 2016 as my last date at work, completing 4 years and 195 days, will I be eligible for claiming a gratuity payout?

In order to be eligible under the Payment of Gratuity Act, one must work for five years or more and complete 240 days of service per year. Therefore, in your case, it appears that you are not entitled to gratuity. For more information on labor laws, please visit www.labourlawhub.com.
