Gratuity Calculation and Notice Period: Eligibility and Service Duration Clarification - CiteHR

I joined the company on 19th August 2007 and left on 28th January 2016, completing 8 years, 5 months, and 9 days. I paid the notice period until 8th March 2016. Am I eligible for gratuity based on 9 years or 8 years of service? In other words, is the notice period paid considered for gratuity calculation?

Hi Buddy, Buy out period should not be considered as a CONTINUOUS SERVCE according to the Gratuity Act-1972 hence get gratuity for 8 years. With Regards Mr.Thumbs Up
