Please solve my confusion. If an export company office is located in Delhi and the factory is located in Haryana, in that case, will the minimum wage be paid by the employer according to the Delhi Minimum Wage Act or the Haryana Minimum Wage Act?

The minimum wages of employees in any office should be fixed as per the respective states' acts. Therefore, for Delhi office employees, it should be in accordance with the Delhi Minimum Wages Act, and for Faridabad, it should align with the Haryana Minimum Wages Act.

Where is the confusion here? The facts are very clear. If tomorrow you shift your company office to Mumbai, or abroad (since it's an export house), will you pay your factory workers at Gurgaon the wages applicable to Mumbai, or the country where the office is located? I hope you understood what is being conveyed.

Dear Sir,

There is no office situated in Haryana; only workers are working in the Haryana factory. All official work is done at the Delhi office. The total official staff is working in Delhi, and the factory is running in Haryana.

If employees are working in Haryana, they will be eligible for Haryana minimum wages, and if they are working in Delhi, they will be eligible for Delhi minimum wages.

Dear Nitin,

Have you not obtained a Factory Licence from the Haryana Government? Are you not conducting sales and purchases under the Haryana VAT Act? Is the factory operating solely based on workers, or are there any supervisory staff members working there? If you are manufacturing excisable goods, is your Registration Number in the Haryana Range?

In reality, there are numerous factories in Haryana near Delhi whose offices are located in Delhi. You could conduct a survey in the area to ascertain which laws they are adhering to.

Respected members have already clarified the point. Your office location, in fact, does not justify the applicability of laws.
