I am working with champ info software noida sector 63 location as a medical coder. I joined this organization on 1st sep 2015. This is startup company. In month of November they terminate me because I was takeing 1 day leave without any information. They did not give my relieving letter and salary of this month. I called the company hr and asked her to give my salary but she told me i am in 2year bound if I am pursuing 5month notice than they will took my salary and I am under probation period. But I did not able to pursuing 5 month notice because I will join another one organization.
Please assist me.

Did the company, terminate you or you left on your own, because of the disagreement with the manager?
You have made 2 different statement from the companies end. Give the clear picture.
The company cannot ask for notice period if they have terminated you. So what is the reality? Have you left because of a fight with the manager or have they removed you.

They was terminate me but they did not give any termination letter they took my company id card. And now they told me if I am pursuing my notice than they will give my November month salary. And I did not fight anyone or manager my TL shouting me and miss behave with me.

Dear Medha,
Approach your HR, tell them that they have terminated you, the question of Notice Period does not arise, Infact, they need to pay you salary for asking you to go on immediate basis (hoping you have not put the resignation in writing).
Also, if they do not pay you the salary immediately, then you will have no option but to meet the local labour office for filing a case.

Do approach the authorities, only if you are completely justified in what ever you are saying. I still have a doubt that you are hiding something in regards to your termination.

Hi ashutosh,
I did not hide any conversation between me and my employer. I approached my hr but she told me again and again if I want my salary of this month than I will pursuing my 5month notice than employer will send my 6 month salary in the last month of notice. HR also misbehaved with me.
