Yesterday (03.11.2015), a conference (seminar) was organized by the Labour Office at Delhi Secretariat.

Honorable Labour Minister Mr. Gopal Rai was the Chief Guest on the occasion. The program was headed by senior officials (DLC, ALC, Secretary, Commissioner) of the Labour Department of GNCT of Delhi.

In his speech, the Honorable Labour Minister strongly insisted not to abolish any Labour Rule. He emphasized the importance of various Contractors and Principal Employers implementing Labour Welfare-related Acts. The observations from various contractors also noted issues related to Government departments and Principal Employers.

Considering the speed of inflation, it is very difficult (almost impossible) to survive on the existing Minimum Wages. The following points were mainly considered:

- Payment as per MW Act, 1948
- Contract Labour (R&A) Act, 1970
- Payment to Labour through Cheque, ECS only (no cash payment)
- Obtaining Labour License & Registration Certificate (if applicable)
- Mandatory Compliance of Statutory Benefits
- Uploading of Compliance Records on the website (Contractor or Principal Employer)
- Implementing various other payments (Bonus, Gratuity, W-off, Leave Encashment, etc.)

The main agenda was how to monitor and implement the Labour norms for the manpower deployed through various contracting agencies (Technical Manpower, Security, Housekeeping, Hospital & 4th Grade staff, etc.). It was a meeting where many points were raised for awareness regarding Labour Rights. The government may revise the L1 tendering process. Statutory Compliance will be a must, and any changes in the Minimum Wages will lead to an increase in the contractor's price to accommodate the extra compliance cost.

The senior official from the Labour Department notified all Principal Employers to strictly monitor the Labour Laws/norms of the contractors. Principal Employers should timely release payments to the contractors, and there should be no influence from the Principal Employer or Third Party over the contractor regarding the employment of labor at the site.

The Delhi Government may soon launch/implement a notification through which the implementation of Labour Rules will be 100% mandatory, failing which will lead to serious/major action.

Also attached are various DO's and DON'Ts for Principal Employers and Contractors under the Contract Labour Act, 1970.
