Hi
I joined a new BPO company in May 2015 called Admiral Solutions (EUI Ltd) which is located in Delhi. Due to pressure from consultant I had to show fraudulent experience. During the Background Verification, I got caught on 28 July 2015. I was terminated on the spot. The Company says they will not do Full & Final Settlement nor will they pay my salary.
Other companies in the industry do pay the salary even if they terminate the employee on grounds of misrepresenting the facts like Aon Hewitt, Amex etc
Is this legal? Can a company withhold my salary?
Can the company file a fraud case against me?
All help will be appreciated
Thanks

""Due to pressure from consultant I had to show fraudulent experience""
Cardinal error.
No point trying to now blame consultant for this intentional mistake.
You can request your company to overlook this mistake on the grounds that your consultant adviced you to do so and that you do not have sufficient experience in work related matters and was not fully aware of the consequences.
Verbal requests to release your payments can be made.
Company can take legal action against you,if they really desire.
But I do not think they will waste their time and money in pursuing a case against you.
But you will have to compromise with the company and find mutual solution.
Lesson to be learnt ----Never fudge experience, documents etc.
They make your position weak.
