Can 2 workers from the same family (eg. husband and wife) working in the same factory be entitled for ESI separately? Is there any legal care that one should take in this regard?

Dear Deeparayncyan, What about their ESI deduction? If you deduct their ESI then obviously they are eligible for the ESI facility. Thanks, Dinesh Divekar

1. Sir, social security benefits, viz., benefits under the ESI Act of 1948, are payable as a result of contributions by individual employees and their eligibility based on such contributions. If two insured persons who are related to each other (such as husband and wife, or brother and sister, etc.) are working in the same unit, it makes no difference.

2. If both a husband and wife are working in the same organization and both are covered under ESI, they will receive their benefits separately when the occasion arises, depending on the applicable rates. However, an insured woman, whether a wife or sister, will also be entitled to maternity benefits.

There will be many such cases of both husband and wife being insured persons (IPs) due to their employment in a firm covered by the Employee's State Insurance Corporation (ESIC).
