I have some doubt regarding ESIC annual return. Can anyone guide me on whole procedure of filing ESIC annual return. Regarding PF, I enquired in EPFO (Jhilmil) & came to now that we don’t need to do anything extra for annual return. Being from employer side, we only need to submit PF monthly contribution on time, that’s it. I am just wondering about ESIC. If anyone can help then that would be really great.

I believe currently there is no requirement for the submission of any Annual Return under the ESI Act and the rules/regulations established thereunder. Could you please inform me or provide further details on the provisions of the rules/regulations that necessitate the submission of the aforementioned Annual Return?

I am not sure about the rules. It's the only reason I am gathering information. Currently, I work in a Pvt Ltd company, and until last year, we hired a consultant for compliance purposes. Now, I am the only person taking care of all the compliance aspects. I recall that the consultant collected many documents from us last year for the annual return. Therefore, I am a bit concerned about the same. At present, I am only submitting the monthly contributions. Do I need to do anything more regarding PF and ESIC?

It will be difficult for me to suggest to you regarding statements in respect of EPFO. However, as far as ESI is concerned, may I kindly request you to indicate whether you are depositing contributions under the ESI Act online every month?

Regarding the Annual Return under the ESI Act, please indicate if you have an office copy of the annual return that was filed or submitted by your ex-consultant/advisor. If so, kindly inform me on which proforma he has submitted the same.

Actually, I have no idea about annual returns. This is the only reason I am trying to gather the information. I have been working for almost the last 7 months, and until now, I have only submitted the monthly contributions. Do I need to do anything more regarding both PF and ESIC?

Dear member,

Please indicate in your reply whether you are depositing the contribution under ESI Act online. If so, as I have heard, there is no necessity for the submission of the 6-monthly Return of Contributions. I understand that if the contribution is deposited online, the said return is reported and generated online. Please confirm the same from the Branch Office of ESIC to which your unit is attached.

Dear Barkha,

Under the new system of filing the monthly contributions and returns online, there is no provision for filing annual returns either under PF or under ESIC. For confirmation, please have a look at the website of each of them. They have a FAQ section and a returns section, both of which will give you the information you need.

Due to the online system under EPF & ESI, ECR is submitted every month online. There is no need to submit the return, as mentioned on the EPF site when you log in to submit the monthly ECR. There is no need to submit any documents, and the same procedure is in ESI. All the data is clubbed automatically while filling the month-wise ECR.

Please do some basic research on your own. It helps in the long run not to depend on others for the answer always. Go to the PF website. The details of the current requirement are provided there. There is also a FAQs section where answers would be given. The same goes for ESIC. In any case, there is no provision on the portal for returns. They won't accept it by post or physically. So where will you file it?
