Hi,

Is it legal for a private life insurance company to force their employees( sales staffs) to resign , as they are not pleased with their performance and make them leave immediately ; Afterwards all of those employee received e-mails from HRD of their ex-employer, stating that they have to pay compensation for the notice period not served as defined in their appointment letter ?????

I was one of them and I had to resign during 2011.Neither I've received any relieving letter from them till date, nor the F&F .

When I reverted back to their e- mail , they just stopped communicating.

Most of my batch-mets (met them while joining ) has gone through similar experience and for those, who were working with that specific channel ( has departed with violent experience i.e. explicit verbal abuse) , it was a normal phenomenon .

Can a public limited company carry on with such bad HR practices ??

Would appreciate some comments and suggestions from senior hr personnels and personnel conversant with corporate law.

would like to thank citehr for giving me an opportunity to share this experience .

Dear Upalray,
Your resignation was taken forcibly in 2011. But then why the company is raking up issue now? When did you receive notice for the payment of notice period? When you submitted the resignation why you did not take proper clearance and acquire "No Due Certificate"?
Secondly, if the resignation was taken forcibly from couple of employees then why all of you did not show unity and served lawyer's notice to the employer?
I find disconnect in your post. Please give complete information in chronological order.

Actually , I think the management of that company is sadistic . Because they have given a derogatory comment in my employee background verification through CRP check. I have just lost a very good job opportunity because of that on 14th January 2015 :( , and that was topic in my first posting in this site. Would request you to go through the topic link given below.

To state after four years that you were forced to resign does not go in your favour. However at the same time asking by HR to give notice period amount after three years is barred by limitation and not recoverable by him in any case.
