Thank you for responding to me. I apologize for the typo error. I was working with an organization as an HR executive since August 2012. I resigned from my position in the middle of December 2014. Even though I was serving a one-month notice period, during that time, my immediate boss (who is the junior director of the company) scolded me and pressured me to find my replacement. He had already lined up several candidates for the position. I was not obligated to find a replacement, but I was diligently doing my work. However, my immediate boss refused to conduct interviews and started behaving rudely towards me. He instructed me to leave the office immediately without allowing me to provide any handover.
Following this incident, I informed my senior director. After exchanging emails with him, I requested for my dues and salary to be settled amicably. Unfortunately, they have not responded to my requests via email. As a result, I sent them a legal notice through my lawyer on his letterhead. According to the legal letter, my employer is required to respond within 15 days. However, today marks the end of this deadline, and I have not received any response from them.
I am now seeking legal guidance on the next steps to retrieve my documents and salary from my previous employer.

Dear Kavita,
If you have served a lawyer's notice to your past employer and there is no response from the employer, then your lawyer is the best person to guide you. Now, no more options are left except filing a suit against the employer. Let the court issue the summons. Wait for them to make their next move.

You need to approach the labor commissioner of your area and file a complaint against your employer for it. The competent authority to decide this matter is the local labor commissioner. Please approach him with an application detailing everything, and I am sure that you will get a resolution.

With due respect, I do not think that a person in an HR executive position is performing clerical or supervised duties that would place them in the role of a workman. If this were the case, the labor commissioner would refrain from exercising jurisdiction as the aggrieved party would fall outside the purview of the ID Act. This is why the aforementioned details were requested in the previous note.
