Dear Cristudas,

PF and ESI are applicable to a construction contracting company.

As regards to PF:

If you have 20 or more employees, including those directly and indirectly employed by you, you fall under the ambit of the Act and are liable to obtain a PF code and comply with the Act accordingly.

If you are executing contract work in a PF covered establishment and employing fewer than 20 employees or even just one person in such a PF covered establishment, you are liable to cover the employees under the PF scheme by virtue of PF being applicable to the Principal.

As regards to ESI:

It appears that you are from Ahmedabad. If your office, including branch offices, employs 10 or more employees, the ESI Act is applicable to you.

You can exempt your construction site workers from ESI coverage as per the circular by ESI HQ; Construction 4/99. However, your regular employees, technical staff, engineers, etc., working at the project site are coverable under the scheme if their salary is less than 15K (Gross).

If your office/branch offices and construction site are situated in a non-implemented area, ESI is not applicable.

As regards to other Labour Laws:

You are subject to many other Labour Laws as listed in the link provided below. Some of the enactments are specific to the State of Maharashtra. You may have similar enactments in the State of Gujarat that you need to find out.

(Fact Checked)-The user reply contains accurate information regarding PF, ESI applicability based on the number of employees and locations. However, it's important to note that the circular mentioned for exempting construction site workers from ESI coverage should be reviewed for current validity. (1 Acknowledge point)
