Hi Vijay Behra,

As pointed out by Lavika Yadav, your post lacks clarity. In order to receive the input of knowledgeable members, please respond to the following questions:
- Where did the accident take place - inside or outside the factory?
- What is feasting for the worker? Or is it fasting?
- "Investing" does not seem to be appropriate. Do you mean "investigating" or "investigate"?
As rightly pointed out by Narendra, as a principal employer, why was contractor wage payment not ensured?
Has your company paid the contractor for the two months in question?

Dear Mr. Bijay,

You are employing the workers through your contractor. The liability for the payment of compensation in case of an accident, and in default in payment of salary by the contractor, rests with the Principal employer. The cost of such payments can be deducted from the contractor's bill. The Principal employer cannot escape from these payments in case of default by the contractor.

As our friends have pointed out, please elaborate on your query in detail so that we can guide you. Without clarity on your doubts, we are unable to advise you suitably.

As cited above, the facts suggest that the employee working within the premises is a contractual worker who was not paid his salary by his contractor. In the event of any type of casualty, the responsibility for his compensation and benefits should lie with the principal employer, rather than the contractor, as the worker is operating within the territory of the principal employer.
