Good Morning,
I joined in a reputed IT MNC on april 22nd 2014 as a fresher...I got trained for 1.5 months in banglore and then got the posting to chennai...I recently got married and my husband is staying in hyderabad...I signed a bond for 1.5 yrs saying that if i quit during this period i have to pay 125000...I was promised an annual salary of 300000 at the time of joining...But after i came to chennai the salary was revised to 17,546 which after various cuttings i am getting only 14500...Due to some personal health problems i had to attend to some tests in hyderabad weekly...so my expenses have increased and after fighting with hr for the past two months regarding the salary and having no result what-so-ever i decided to quit...when i told my hr about my decision they said that if i quit now i will be considered as absconding...I donot need a relieving or experience certificate as it is only 5 months...Can the company force me to pay the bond amount?
Thanks.

Unfortunately Yes!! According to company's policy, if an employee quits before the bond period, he/she shall be liable to pay the penalty amount.
You can talk to HR and negotiate for a valid solution. On medical grounds, sometimes company may give benefit to the employee. Sometimes the company will grant you leave without pay till the time you are fit to resume your work. You can talk to HR and ask more about your company's policy about this.

Hi Anonymous,

To start with, if you were expecting to get married in 1.5 months, I'm assuming that you knew where your fiance worked, so you should either have informed the compnay of the same and asked for a posting in Hyderabad or not joined in the 1st place. And why you signed a bond in this situation is beyond me.

Please check your offer letter to see if the 3,00,000 was Net/Gross pay or CTC, as it makes a huge difference in the steps you could take.

Do you have any original documents tied up in the company, if not than it is easier to negotiate your release.

Check if your company has a legal dept. and if they face huge turnover in employees, this can influence their decision to go after you, most company's won't chase a fresher as it is expensive (legally), not worth the effort (as you're a fresher), and since you are a woman, could rebound on them (socially), however some make it a point to do it as a matter of princple.

If it is core IT job, coding/programming or testing that can be done on a laptop, check if they will let you work from Hyderabad, most probably they won't let you do this as you're a fresher, however by offering it in writing you show that you are trying to resolve the issue to the best of your ability.

If your company does not give you leave for your health issues, and if they are problems are related to femininefertility issues which are not treatble in Chennai, you can raise that as a claim for early relief.

A word of advise:

1. In your dealings with the HR, be polite (no point in making them angry)

2. Get everything in writing (e-mails)

There are always differences, for a female employee like that you are facing. Better be accountable and see your company show the generosity. Explain, the reality to the HR department give time to them wary in statements always put every one in trouble. You might have get progressed after employment and got a nice good husband, yet, the company too invested in you for their time and bought your time for them and in the present situation every one need to be accountable for their acts which is rarely available at all corners. Better have a good approach you will be awarded.
