I m working as HR Executive in Mangalore. One of our employee joined on 25th Nov 2013. She was on probation period for 6 months. Since her delivery date is on 1st October 2014, She is in leave from 1st september 14 and probably upto 31st december , 14. Kindly guide me is she eligible for maternity leave as she just completed her probation period. if yes for how many days maternity leave she is eligible for? Also tell me for how many days payment can be made to her while on leave and how much salary amount can be paid, is it the full one month salary or a part of salary. Kindly guide me.

Yes the female employee is eligible for Maternity Benefit, the leave of MB is for 12 weeks i.e. 84 days. 6 weeks before expected date of delivery and 6 weeks after delivery. She is entitled for full salary and not part. Please refer the Maternity Benefit Act which will be knowledgeable to read and understand.

Yes she is. To avail Maternity Benefit one has to completer 80 days, She has already completed her 80 days. Then she can get benefit. Regards Dinesh Kumar

She gets the full maternity benefit as she has completed 80 days of working before the maternity leave. Also the act does not differentiate between probation and permanent employee. There is no part payment in maternity act.
So she gets the entire benefit. download the maternity benefit act for documentary proof.
