Sorry, I do not mean to hurt you or demoralise you. I wish to draw your attention that some time we write something such a way that one can take it other way round.

Dear Friend,
If an employee is drawing a salary of Rs15000/ per month (Gross), ESI contribution is payable. ESI contribution is not payable if an employee is drawing more than Rs15,000/ per month, and such employees shall be outside the purview of ESI Act.
Half yearly return is required to be submitted twice in year.Half yearly return for April to September (Six months) to be submitted by 20th October and for October to March to be submitted by 20th April.This half year is called as contribution period.
During the period of contribution as mentioned above if the salary of an employees exceeds Rs 15,000/ per month , ESI contribution shall be paid till the end of contribution period in spite of exceeding salary ESI limit .The concerned employee shall get ESI benefit till date of next contribution period.

Dont worry... i am not missunderstan you... i got your queiry & raised question valid & i appreciate that,
as THE EMPLOYEES’ STATE INSURANCE ACT, 1948, under section, 2, definitions, sub clause 9 (III),B, & 10" Employee"
1[or any person engaged as an apprentice, not being an apprentice engaged under the Apprentices Act, 1961 (52 of 1961), 2[and includes such person engaged as apprentice whose training period is extended to any length of time]
but does not include] —]
(a) any member of 3[the Indian] naval, military or air forces ; or
4[(b) any person so employed whose wages (excluding remuneration for overtime work) exceed 5[such wages as may be prescribed by the Central Government] :
Provided that an employee whose wages (excluding remuneration for overtime work) exceed 5[such wages as may be prescribed by the Central Government] at any time after (and not before) the beginning of the contribution period, shall continue to be an employee until the end of that period ;]
(10) “ exempted employee ” means an employee who is not liable under this Act to pay the employee’s contribution ;

Dear All,
1.ESI Applicable to Every Establishment having 10 or more persons irrespective of wage limit , establishment has to get code under ESIC provisions without fail ,
2. As per as ESIC provisions are concerned , every employer who is having gross wages less than or equal to 15000 per month, in such he case he/she covers and under esi provisions
3. Employer has to contribute 4.75% on monthly earned gross wages and has to deduct 1.75% from Employee end
4. Both the contributions has to remit on or before 21st of every month.
5. No separate hard copy of Half yearly and annul return are required to be submitted with regional office,filing of monthly return through online and submssion of self certification is sufficient compliance under esic

Dear Mr. Sibabrata Majumdar,
Ok fine, Agrees that during the period of contribution if the salary of an employees exceeds Rs 15,000/ per month, ESI contribution shall be paid till the end of contribution period but ....... in spite of exceeding salary ESI limit does not clear....... whether it will be on 15000 or on the salary earned +15000. If on +15000, please provide any written explanation / notification in support of your statement.

Dear Kunalbanerjee,
ESI is deducted on monthly gross drawn including overtime. Even the monthly gross drawn is more that Rs.15000 with overtime amount, you need to deduct ESI on the gross amount including the overtime.
