Dear all,
I am working with the company which having main office at x location (In ESI Zone) & having 7 to 8 engineers/Executives across the india at various states say one is at Banglore one at UP in the same area where ESI applicable. At every location only one employee is available & they are eligible for ESI benefit also.
I already drawn WC policy, Mediclaim policy for the all of them.
Question is that -
1. M i required to go for ESIC registration, if already i have wc policy?
2. M i required to take sub code for each region or i can submit the amount in main office
Please help me out

Dear Bhsakar, If your company have 10 or more than ten person in any month of ayear then ESIC is applicable. you need to register under ESIC.

Agreed but see at x location their are 100 no. of employees among them 25 are eligible i am submitting the esic contribution for them no doubt but question is of the 7-8 employees who are in various states and the number in each state is only one at every state.
In that case what about the compliance under esic for those 7-8 employees.

Dear Bhaskar, You need to take separate sub-code for each location in order to ensure proper compliance and getting the benefits to the eligibile employee under the ESI Scheme. Regards M.S. SANKHLA

So its not create problem take the online number from your main code and assign despenciary from working location this can reslove your issue because now a days ESIC is online any one get benefits form all over india

Dear Bhaskar
You need to cover those engineers working in other states if you exercise supervision and control over them like paying their salaries or sanctioning their leave or exercising disciplinary jurisdiction over them, since they will be considered as part of the establishment located at X location but not as seperate entities.

Dear Mr. Bhaskar,
ESIC is Applicable for all your employees at all locations.
Criteria for Esic coverage -
Salary Limit - <15000,
Subcode - For Other states to be taken,
No of employees in organisation - 20 or more
Apart from this we can have exemptions from esic registrations provided the benifits provided to employees are more than that is provided by Esic.

Dear Sir,
In Case of statutory ( Your office having 20 persons/drawing RS.15000/- below per month ), it is
a must. You have to obtain ESI Registration. In such case you can discontinue the WC Policy.
In case, your office is not having 20 persons, ESI not not necessary. You can continue the WC Policy.
