Dear Sir,
I am Manohar. I have just one question: Can I deduct ESI for all employees working in one company across different branches? For example, if the head office is in Bangalore but there are branches in various locations in India, can I deduct ESI for all branch employees in Bangalore (HO)?

Dear Sir(s),
The payment of contributions as due and payable under the ESI Act can be made by the employer at their Head Office, which may be located in any of the implemented areas. The only condition, in my opinion, is that the contribution is to be paid branch-wise by indicating the sub-code, and the return of the contributions for the contribution period is to be submitted to the appropriate Branch Office or sub-Regional Office, etc., of ESIC located in regions where branch offices of the factory/establishment are situated. Additionally, the insurance numbers of the employees working in the branch offices are also to be obtained from the respective branches themselves. This is important so that employees can access ESI benefits as and when needed.
With the introduction of the online procedure in ESIC offices, the process of payment of contributions and submission of returns must have become more simplified.
I suggest that the member who initiated this discussion kindly contact the appropriate regional office of ESIC where the Head Office is located, along with the sub-code numbers of all branches, and discuss the issue.
Sincerely,

Dear Mr. Manohar,
According to the statute, you are required to create subcodes for every branch, irrespective of the number of employees employed therein, and ensure ESI compliance for them. However, in case the branch is located in a Non-Implemented Area, ESI compliance for those employees is not required.
Hope that helps.

Dear Friend,
I am in agreement with the views expressed by Mr. Darshan Balai. You have to obtain sub-codes for all branches. After that, ensure that ESI compliance is done for those employees who fall under the ESI coverage. It is applicable to employees working in the implemented areas only.

Dear,
If the branch sub-code number is not applicable or allotted, use the sub-code number of your Head Office for depositing ESI contributions of your branch office employees.

Dear Manoharji,
You have to obtain a sub-code for all branches, and then they will provide you with the sub-code and password specific to that branch. You will need to make the ESIC payment on the branch's website. If you need any clarification, please let me know.
