    In my view, the contractor should get the BOCW license as he has to bear 1% cess on the total contract value. If the contractor subcontracts part or all of the work and the subcontractor works on behalf of the main contractor (meaning the subcontractor may not be visible to the principal employer), at this point, the subcontractor does not need to obtain the BOCW license. Otherwise, even the subcontractor should acquire the BOCW license.

    As per the BOCW Act, the Principal Employer for whose benefit the construction activity is being undertaken is liable to register with the BOCW Dept. He can deduct, if the contract clause permits, labour cess at 1%. All basic facilities for labor such as a first aid box, water, sanitation, gum boots, hand gloves, safety belts, etc., must be provided by the Contractor. Additionally, sufficient safety measures such as Fire Fighting equipment, guards for Mixer Machines, and barricading all equipment where some sort of accident may occur should be taken. Besides, testing certificates of equipment should be obtained. Hope this information is helpful to you. Thanks.
