Hi,

A warm greeting from my end. I am a bit confused as I recently received a recovery letter from my previous organization demanding me to pay an amount of Rs 8900.

The issue is I quit my previous company due to better prospects, and I didn't serve the notice period because my immediate manager informed me that I had to give a 30-day notice period. Although I was willing to serve 15 days, he denied my request. As a result, I quit the organization without giving any notice period. There are 22.5 days of my leave balance that were not adjusted against my dues.

Can someone help me with this? Is it because I did not serve the notice period that the employee is not eligible for his leave to be adjusted against his dues?

Hi Aminsha , As per HR policy or terms of your appointment letter they are right . but they are not in condition to recover the amount by law . so no need to worry ...... Regards Rajvir Singh

out of your balance 22 1/2 days leaves, you will get encashment for PL only in F/F settlement after you pay the notice period amount. This is normal practice. Pon

@Pon, am I not eligible for the 22.5 PL that was earned by me? I was ready to give a 15-day notice period, but my immediate supervisor refused to accept it because, as per company policy, it has to be 30 days.

Additionally, I was informed by the HR manager that if I marked an email to HR and my supervisor, I would not be considered as having absconded. However, I have now suddenly been marked as absconded.

Please help me as my last working day was September 12, 2013, and I have 22.5 PL, so it cannot be considered as a 30-day notice period.

Dear Aminsha,

What I suggest is that it is wrong practice to leave a job without obtaining clearance or submitting a written resignation. It will damage your image in the market. By the way, you should go back, fill out the PF form if it's there, complete the gratuity form if available, settle the leave account, and request them to issue an experience certificate with positive remarks. This will definitely help you in securing a good job, or your option to return will remain open. The rest depends on you.

Hi Daljeet,

I have given the resignation through email, intimating my immediate supervisor and HR. I have also informed them that I am not in a state to provide a notice period as I can't leave the opportunity.

I was also asked to fill the exit formality form the day I resigned, and there is no PF deduction in the organization for any employees.
