i have been working in a reputed company for two years but recently was terminated from work due to being abscond.will i get the gratuity for the two years i have worked for.and also will i receive the relieving letter from the company.and can i claim for the pf. in case if the employer denies approve the PF can i do something about..need your suggestions

Absconding is voluntary termination. No you would not be entitled tpo Gratuity. you can withdraw your PF per rulkes

-you were absconded and was terminated, so "What do you think TERMINATION" is and has it caused you ever by anyhow
-are you working currently anywhere or not
-what made you to take this step of ABSCONDING and why you didnt resign which was the appropriate way to take leave ..
-have you tried to speak with your HR with previous employer and requested for Reliving Letter
-if yes, what are the responses by them
-and have you applied for withdrawal of EPF
-Lastly, did you get the termination letter and full and final settlement from your company or not.
Is this query relate to "Gratuity" only and not related to your career, what do you think about it?
As of now you have not shared about you therefore, it is not an easy to say what your HR personnel will do. So in that case the above posted questions will help me and other members to understand your situation and will enable us to give you appropriate answers.
Second, I'd suggest you to think about it and meet your HR personnel with said company with your query/questions which is the best way and NO YOU WONT BE ABLE TO GET GRATUITY

Hi, Absconding is voluntary termination. No you would not be entitled to Gratuity. you can withdraw your PF per rules. You should be getting your relieving letter after you F&F is settled. regards

Absconding is an involuntary exit ,you cannot avail Gratuity .regarding your experience letter and FnF depends on company policy i.e in HCLTech if you abscond you will get the exp letter after 6 months of date of termination provided there are no dues by the employee

in case if the employer denies approve the PF can i do something about If you are in new job where you have PF Account you can transfer it to your New PF Account, please approach your New HR, if you are not on job you can visit your nearest PF Office and submit necessary forms with an attestation of any Bank Branch Manager in lieu of your Previous employer signature on forms with your cancelled cheque/Bank Statement
