Comprehensive Analysis of Employee Leave Policy and Entitlements - CiteHR

Dear Seniors, please let me know if this policy is okay and if I am missing anything in it. Also, please let me know the meaning of point no. 3 in Entitlement.

Leave Policy

Objective:

The policy sets up guidelines for facilitating employees and the organization to understand leaves, their procedures, how leaves should be availed, and the encashment of leaves. Based on the need/reason and length of leave, the following categories of leave can be availed.

Entitlement:

1. All employees shall be eligible for 30 days of paid leave for each calendar year starting on 1st January to 31st December of the subsequent year. Employees joining the service of the company during mid-year will be entitled to pro-rata leave from the date of joining.

2. At the beginning of the next month, leaves will be credited to eligible employees on a monthly proportionate basis.

3. Employees have to plan their leaves for the year well in advance, and they can avail a maximum combination of 2 weeks leave on any one occasion. Balance leaves can be consumed individually or combined up to 2 days separately during the year.

4. The Department Head, and in certain cases, the Discipline Head will have absolute discretion to sanction, defer, refuse, or cancel sanctioned leave as per the exigency of work. Additionally, if an employee is associated with ongoing project work, weeklong leave must be approved by the project manager of the same project.

Types of Leave:

1. Casual Leave

2. Privilege Leave

3. Maternity Leave

4. Paternity Leave

5. Special Leave

a. Marriage Leave

b. Education Leave

Eligibility:

Applicability guidelines are given under each head.

1. Casual Leave:

All employees are entitled to 15 Casual Leave per annum. Casual Leave will be granted by the Reporting Manager/Departmental Head, only for casual exigencies such as religious functions, sickness of family members, and personal or domestic reasons. An employee, however, shall not avail more than two days of Casual Leave at a stretch.

Saturdays, Sundays, holidays, and other weekly off days falling before, after, or within the period of Casual Leave shall not be counted as part of Casual Leave.

The balance of Casual Leave that is not availed within a year will lapse at the end of the year and cannot be encashed at any stage.

Only for emergencies where absence of a few hours (less than 2 hours) is needed, the associate can take time off with prior authorization from his/her Line Manager.

2. Privilege Leave:

All employees are entitled to 15 Privilege Leave per annum. Employees shall apply in advance for Privilege Leave, and advance approval is required for the same. A minimum notice of 20 days shall be required to be given by the employee. Eligibility is on completion of the probation period. Privilege Leave cannot be combined with any other types of leaves. Unutilized Privilege Leave will lapse.

3. Maternity Leave:

Entitlement:

1. Women staff members who have worked for at least 3 months with the Company are entitled to Maternity Leave up to 90 days (inclusive of weekends & holidays) for each occasion.

2. Of the 90 days, a minimum of 45 days leave should be taken after her date of delivery.

3. In the case of miscarriage or if pregnancy is terminated on medical grounds, additional leave up to one month is allowed.

4. A medical certificate is required on resumption of duty.

4. Paternity Leave:

Entitlement:

1. Male staff members who have worked for at least 3 months with the Company are entitled to Paternity Leave up to 10 days (inclusive of weekends & holidays).

2. Paternity Leave will be taken in one go. The un-availed part of the leave shall lapse.

3. Paternity Leave cannot be accumulated or encashed.

5. Special Leave: (Employee eligible after one year of service)

Marriage Leave:

An employee getting married will be given an additional 5 days paid leave over and above the normal leave.

Education Leave:

An employee eligible to take 5 days for attending higher education exams, seminars, training within India or outside of India. (Approval to be taken in advance from the Country Manager)

Unauthorized Leave:

If an employee remains absent without authorization or overstays the period of leave originally granted or subsequently extended for a period of 3 consecutive days or more, he/she shall lose lien on his/her appointment and would be deemed to have voluntarily abandoned his/her services without any further notice.

I am not clear about the maximum number of leaves that any employee will receive per year, excluding Marriage, Maternity, Paternity, and Education Leaves. Are Paid Leave and Earned Leave the same, or are Earned Leave and Privilege Leave the same, or are they all different?

There is no clause specifying how many CL (Casual Leave) any employee can take in a row. Can an employee take 5 or 10 days consecutively?

According to the policy, if I am not mistaken, all employees have the right to take 60 leaves per year.

Kindly provide specific details.
