Hello Everybody,
I am Chetan from Mumbai (India). I worked for a company for 9 months & i resigned on 7/8/2013. My probation was for 6 months but it was extended for further 3 months by the company. The offer letter mentioned that i have to serve a notice period of 1 month post confirmation.
My probation ended on 28/7/2013 & i stopped going to office from 1/8/2013 & resigned (via email) on 7/8/2013. I didnt receive any confirmation letter from my company till 31/7/2013. Hence i dont think that i am supposed to serve a notice period of 1 month as compulsion.
Now i want to know what i can do if my employer doesnt pay my full & final settlement amount. Is there any laid period to complete the same??

Pls. clarify the following:
1. Is your salary is structured or paid as stipend / lumpsum.
2. If it is structured pls. provide the same?
3. Do you have any benefits like Leave Salary, LTA, Medical, Gratuity, PF etc.,
4. Whether you have received your salary for the month of July 2013.
5. Have you submitted your original certificates to the employers? If yes, what does your appointment letter talks about it in case of unauthorised absence. Because, there is always possibility that employer can say that they have not accepted your resignation and force you continue the services.

Sir,
1) Yes my salary was structured.
2) It has - Basic, HRA, Additional HRA, PF & Medical allowance,Bonus.
3) Gratuity was also there in the ctc.
4) No i havent received my salary for July'13 as they have put it on hold.
5) Original documents are with me only. There is no notice period while on probation as the offer letter mentions that one has to serve a notice of 1 month after confirmation if he/she wants to resign.
I have again sent an email to them & got a reply that they want me to hand over my responsibilities to the concerned person & have asked me to come to office for the same.
I will go to the office as requested & try to complete all the formaiities. After that if they still dont give me my salary & Bonus of 9 months then what should i do??

It is advisable to complete the formalities and wait for few days, even after if you are not getting your FNF then approach the forum for help

Hi, If you got confirmation letter before your resignation then you have adhere to the terms mentioned in it. I would advise you to serve notice and take a clean exit. Regards, Ritesh
